This Privacy Policy (“Privacy Policy”) explains how AugmentAI LLC, a Connecticut Limited Liability Company
(“AugmentAI”, “we”, “our”, or “us”), and our website AugmentAI.com collect, use, disclose, and store Personal Data
from or about you (“you”). This Policy applies when you:

  • Visit or browse our website, augmentai.com (“Website”);
  • Use or interact with our Website or Online Services;
  • Contact us for demos, support, or general inquiries;
  • Submit a job application;
  • Download materials from our Website;
  • Attend marketing events or voluntarily provide contact details;
  • Interact with our social media profiles (e.g., Instagram, Facebook, LinkedIn, X, YouTube);
  • Use our web application, mobile applications, API services, or any AugmentAI plugins (collectively the “Software”), including:
    • Creating an account or logging in,
    • Uploading photos, text, and/or audio to generate animations (“Animations”) or outputs,
    • Viewing, downloading, or sharing your Animations,
    • Upgrading to paid services.

This Privacy Policy is designed to serve individuals globally and to comply with privacy standards applicable to users in the
United States, the European Union (GDPR), the United Kingdom (UK GDPR),
Canada, California (CCPA/CPRA), and other international jurisdictions.

“Personal Data” means any information that identifies, relates to, or can reasonably be linked to a living individual.
“Applicative Data” means data you upload or submit to the Software for processing.

Nothing in this Privacy Policy limits your legal rights, including statutory rights in any jurisdiction.

Using the Software

Account Creation & Login

Personal Data collected: Name, email, SSO details (e.g., profile photo thumbnail), device/browser type,
location data, and data you choose to provide.
Purpose: Create/manage your account; personalize features; send notifications.
Legal basis: Contract performance; legitimate interests.

Uploading Photos, Text, or Audio

Personal Data collected: Photos, text, audio that may include Personal Data.
Purpose: Generate Animations or outputs.
We require your permission to access device camera, microphone, or gallery.
You must have authorization for any third-party likenesses you upload.
Legal basis: Consent (device access); contract performance; legitimate interests.

Viewing, Downloading, or Sharing Animations

Personal Data collected: Name, email, SSO data, device/browser info.
Purpose: Access and share Animations.
Legal basis: Contract performance; legitimate interests.

Paid Accounts

Personal Data collected: Payment method details (last 4 digits, expiration date, card provider).
Purpose: Process payments and provide paid services.
Legal basis: Contract performance.

Fraud Prevention, Security, and Legal Compliance

We may use Personal Data to:

Merchandise

AugmentAI-branded merchandise is fulfilled exclusively through authorized third-party marketplaces (e.g., Etsy).
We do not permit reproduction of our branded merchandise.

However, no system can guarantee absolute security.

7. THIRD-PARTY SERVICES

Our Software may interact with third-party sites, apps, or services.
We do not control or endorse their privacy practices.

8. LOG FILES

We collect log data such as IP addresses, browser type, ISP, timestamps, referring/exit pages, and click behavior.
This information is used for analytics, security, and service operation.

9. ANALYTICS

We use Google Analytics and may add or remove tools over time.
Google’s use of information is governed by Google’s Terms and Privacy Policy.
You may opt out using the Google Analytics Opt-out Browser Add-on.

10. CALIFORNIA PRIVACY DISCLOSURES

Do Not Track

We do not respond to browser DNT signals.

“Shine the Light” (Civil Code §1798.83)

California residents may request disclosure of data sharing for direct marketing.

Removal of Public Content (Minors)

California minors may request removal of publicly posted data as permitted by law.

11. APPLICATIVE DATA RETENTION

  • API-uploaded Applicative Data not deleted by the user may be automatically deleted within ~24 hours (unless a persistence flag is used).
  • Persistent Applicative Data is stored securely in encrypted storage (Azure or AWS S3).
  • Applicative Data uploaded via studio.augmentai.com remains visible until deleted by the user.
  • Applicative Data is not used for training models, unless explicitly stated or opted-in.
  • Applicative Data is not accessed for purposes other than providing the service.
  • Inactive accounts (180 days) may be deleted after 14-day notice.
  • After contract expiration, data may be deleted with 14-day notice.
